2. ELIGIBILITY

By using this Website and placing orders, you confirm that:

• You are at least 18 years of age

• You are legally capable of entering into a binding contract under the Indian Contract Act, 1872

• You are accessing this Website from within India

• The information you provide during registration and checkout is accurate, current, and complete

JAAVYA reserves the right to refuse service, cancel orders, or terminate accounts at its sole discretion if eligibility conditions are not met or if fraudulent activity is suspected.

JAAVYA sells physical skincare products exclusively. All products listed on jaavya.com are subject to availability.

• Product descriptions, ingredient lists, and images are provided for informational purposes and are as accurate as reasonably possible

• Colours of products as displayed on screen may vary slightly due to monitor settings and photography lighting

• JAAVYA reserves the right to modify, discontinue, or reformulate any product at any time without prior notice

• All products are intended for external cosmetic use only unless explicitly stated otherwise

• Country of Origin: India — as mandated by the Consumer Protection Act, 2019 and Legal Metrology (Packaged Commodities) Rules, 2011

JAAVYA's products are not intended to diagnose, treat, cure, or prevent any medical condition. They are cosmetic formulations and should not be used as a substitute for medical advice or dermatological treatment.

Due to the clinical nature and high concentration of active ingredients in JAAVYA formulations — including PDRN, Glutathione, Niacinamide, and Alpha-Arbutin — we strongly recommend performing a patch test on a small area of skin for 24 hours before full application. JAAVYA is not liable for predictable skin purging, mild irritation, or allergic reactions resulting from individual ingredient sensitivities, pre-existing skin conditions, or improper application contrary to product instructions.

3A. LEGAL METROLOGY COMPLIANCE

In compliance with the Legal Metrology (Packaged Commodities) Rules, 2011, all product listings on jaavya.com display the following mandatory declarations, identical to those appearing on the physical product label:

• Manufacturer name and address

• Net quantity (e.g., 100ml)

• Maximum Retail Price (MRP) inclusive of all applicable taxes

• Manufacturing date or batch number

• Best before / expiry date

These declarations are displayed on each individual product page on jaavya.com. If you notice any discrepancy between the declarations on the physical product and those displayed online, please notify us immediately at care@jaavya.com.

4. PRICING

All prices on jaavya.com are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.

• Prices are subject to change without prior notice

• The price applicable to your order is the price displayed at the time of checkout confirmation

• JAAVYA reserves the right to correct pricing errors — if a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and issue a full refund

• Shipping is complimentary on all orders — no minimum order value applies

5. ORDERS AND CONTRACT OF SALE

Placing an order on jaavya.com constitutes an offer to purchase. A binding contract of sale is only formed when:

• Your payment is successfully processed and confirmed by Razorpay

• You receive an order confirmation email from JAAVYA at your registered email address

By proceeding to checkout, you confirm that you have read, understood, and expressly agree to these Terms & Conditions, our Privacy Policy, Refund & Returns Policy, and Shipping Policy. A mandatory checkbox confirmation of this acceptance is required before your order can be placed, in compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Acceptance obtained through pre-ticked boxes or implied conduct alone is not considered valid consent by JAAVYA.

JAAVYA reserves the right to cancel any order at any time before dispatch for reasons including but not limited to: product unavailability, pricing errors, suspected fraud, or failure of payment verification. In such cases, a full refund will be processed within 7–10 working days.

6. PAYMENTS

All transactions on jaavya.com are processed exclusively through Razorpay, our PCI-DSS compliant payment gateway. We accept all major payment methods including UPI, credit cards, debit cards, and net banking.

• JAAVYA does not store, access, or retain your financial credentials at any point

• All payment data is encrypted and handled entirely by Razorpay

• Cash on Delivery (COD) is not available on jaavya.com

• In the event of a payment failure, please do not attempt multiple transactions before confirming with your bank — contact us at care@jaavya.com if you face payment issues

7. SHIPPING AND DELIVERY

All orders are shipped pan India with complimentary shipping. Dispatch occurs within 1–2 working days of order confirmation. Estimated delivery timelines, logistics partners, failed delivery protocols, refused delivery procedures, and tampered shipment instructions are governed by our Shipping Policy available at jaavya.com.

In the event of any conflict between these Terms and the Shipping Policy regarding delivery matters, the Shipping Policy shall prevail.

8. RETURNS, REFUNDS AND CANCELLATIONS

Our complete returns, refund, and cancellation framework — including eligible and ineligible cases, the replacement process, skin reaction protocol, and chargeback policy — is governed by our Refund & Returns Policy available at jaavya.com.

In the event of any conflict between these Terms and the Refund & Returns Policy regarding return or refund matters, the Refund & Returns Policy shall prevail.

9. PROMOTIONAL CODES AND DISCOUNT OFFERS

JAAVYA may from time to time offer promotional codes, discount vouchers, or referral credits ("Offers") at its sole discretion. The following conditions apply to all Offers:

• Each promotional code is valid for one-time use per customer unless explicitly stated otherwise

• Promotional codes cannot be combined with other offers, discounts, or codes unless explicitly permitted

• Offers are valid only for the duration and conditions specified at the time of issue

• JAAVYA reserves the right to withdraw, modify, or expire any Offer at any time without prior notice

• Promotional codes have no cash value and cannot be redeemed for cash or store credit

• Products purchased using a promotional code are not eligible for change-of-mind returns but remain fully covered under our Refund & Returns Policy if delivered damaged, defective, or incorrect

• Referral credits, where offered, are valid only for the referred customer's first purchase and are subject to minimum order value conditions as specified at the time of the referral campaign

• Any misuse, duplication, or fraudulent use of promotional codes will result in immediate cancellation of the order and potential account termination

10. USER ACCOUNTS

You may create an account on jaavya.com to manage your orders, track deliveries, and save your preferences.

• You are responsible for maintaining the confidentiality of your account credentials

• You are fully responsible for all activity that occurs under your account

• JAAVYA will never ask for your password via email, phone, or any other channel

• If you suspect unauthorised access to your account, notify us immediately at care@jaavya.com

• JAAVYA reserves the right to suspend or permanently terminate any account that violates these Terms, engages in fraudulent activity, or misuses our platform

11. BLOG AND USER-GENERATED CONTENT

JAAVYA's website includes a blog and may feature user-generated content including reviews, photographs, and testimonials ("UGC").

Regarding our blog:

• All blog content published by JAAVYA is for informational and educational purposes only

• Blog content does not constitute medical or dermatological advice

• JAAVYA retains full ownership and copyright over all original blog content published on jaavya.com

Regarding user-generated content (reviews and photographs submitted by customers):

• By submitting a review, photograph, or testimonial on jaavya.com, you grant JAAVYA a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt, and display your content across our website, social media channels, and marketing materials

• You confirm that any content you submit is original, does not infringe any third-party rights, and does not contain false, defamatory, or misleading information

• JAAVYA reserves the right to moderate, edit, or remove any UGC that violates these Terms, contains offensive material, or is deemed inaccurate or misleading

• JAAVYA reserves the right to remove any content suspected of being artificially generated, synthetically altered, or created using AI tools in a manner that misrepresents genuine customer experience, in compliance with the Information Technology (Intermediary Guidelines) Amendment Rules, 2026

• JAAVYA does not compensate users for submitted reviews or content unless part of a separately documented paid collaboration agreement

• In compliance with the Digital Personal Data Protection Act, 2023, you may request the removal of your user-generated content or personal images from our platform at any time by emailing care@jaavya.com. We will process all such requests within 30 days of receipt

12. INTELLECTUAL PROPERTY

All content on jaavya.com — including but not limited to the JAAVYA brand name, logo, wordmark, product names, product formulations, photography, copy, blog content, and website design — is the exclusive intellectual property of JAAVYA (Aarjav Jain, Proprietorship) and is protected under the Trade Marks Act, 1999, Copyright Act, 1957, and applicable Indian intellectual property law.

• You may not reproduce, copy, distribute, modify, or commercially exploit any content from jaavya.com without prior written permission from JAAVYA

• The JAAVYA™ trademark (Word Mark, Class 3) is a pending trademark application filed with the Office of the Controller General of Patents, Designs & Trade Marks, India. Unauthorised use of our brand name, logo, or any confusingly similar mark is prohibited and will be pursued under applicable law

• Links to jaavya.com from third-party websites are permitted provided they are not misleading, defamatory, or used in a context that misrepresents JAAVYA's brand

13. PROHIBITED CONDUCT

By using jaavya.com, you agree not to:

• Use the Website for any unlawful purpose or in violation of any applicable Indian law

• Submit false, misleading, or fraudulent orders or personal information

• Attempt to gain unauthorised access to any part of the Website or its backend systems

• Engage in any activity that disrupts, damages, or impairs the functioning of the Website

• Scrape, crawl, or extract data from jaavya.com using automated tools without written permission

• Misuse promotional codes, referral systems, or discount offers in a manner inconsistent with their intended use

• Post defamatory, abusive, obscene, or harmful content in reviews or any other user-facing section of the Website

• Submit artificially generated, AI-created, or synthetically altered content as genuine customer reviews or testimonials

• Purchase products on jaavya.com for the purpose of wholesale resale, commercial redistribution, or unauthorised third-party distribution — all products are intended for personal, non-commercial use only. Bulk purchasing for commercial resale without a prior written distribution agreement with JAAVYA is strictly prohibited and may result in immediate order cancellation and account termination

Violation of any of the above may result in immediate account termination, order cancellation, and legal action where warranted.

14. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable Indian law:

• JAAVYA provides its Website and products on an "as is" and "as available" basis

• We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or harmful components

• Skincare results vary by individual — JAAVYA does not guarantee specific cosmetic outcomes from the use of our products

• Product claims on jaavya.com are cosmetic in nature, comply with applicable Indian advertising standards, and are governed by the Drugs & Cosmetics Act, 1940 and Cosmetics Rules, 2020

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, JAAVYA's total liability to you for any claim arising out of or in connection with these Terms, your use of the Website, or the purchase of our products shall not exceed the amount paid by you for the specific order giving rise to the claim.

JAAVYA shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, loss of data, or loss of goodwill — arising out of your use of the Website or our products.

Nothing in these Terms limits JAAVYA's liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable Indian law.
